An application to amend the Cowichan Valley Regional District (CVRD) Official Community Plan (OCP) Bylaw No. 4270 by re-designating the property from Renewable Resource Agriculture to Industrial, and to amend the CVRD South Cowichan Zoning Bylaw No. 3520 by rezoning the properties to a new Light Industrial 1H (I-1H) zone.

April 3, 2019

The application was first presented to the Committee, and the following recommendation was passed:

That Application No. 01-C-17RS (PID: 025-580-311), Bylaws 4275 and 4276, be referred back to staff to review sewer, trail safety and self storage issues.

June 19, 2019

The application returned to the EASC for direction on dealing with sewerage and mini-storage use, and the following recommendation was passed:

  1. That all lots be required to connect to the Cobble Hill Village Sewer System (a community sewer system); and that a Section 219 Covenant be registered on title.
  2. That ‘mini-warehouse’ be kept as a permitted use within the I-1C zone, and add a condition of use that requires a minimum parcel size of 1 hectare.

April 15, 2020

With the direction from the previous meeting, staff presented the application with drafted bylaws. The EASC chose an alternate option in the report and the following recommendation was passed:

It was moved and seconded that it be recommended to the Board that staff be requested to work with the applicant of Application No. 01-C-17RS
(PID: 025-580-311, Fisher Road) to review the list of permitted uses in the
I-1C Zone to consider prohibiting uses that may be deleterious to the aquifer.

April 13, 2022
Board resolution :

That prior to adoption of Official Community Plan Amendment Bylaw No. 4275 and Zoning Amendment Bylaw No. 4276 for Application No. 01-C-17-RS (PID: 025-580-311 and PID: 002-315-408), the following conditions be secured:

a. Registration of a replacement Statutory Right-of-Way for the existing groundwater monitoring well for CVRD access in perpetuity.

b. Completion of a lot boundary adjustment and lot consolidation to clearly identify the future subdivision parcel.

c. Registration of a Section 219 covenant to secure the following:

i. Community water connections installed to the property line of all future lots at the subdivision stage;

ii. Installation of fire hydrants, to the satisfaction of the CVRD Emergency Management Division, at the subdivision stage; and

iii. A restriction on the creation of a shared sewerage system, unless connected to a CVRD community sewer system.
